1. Acceptance of Terms

By accessing or using Misdelivered (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

These Terms apply to all users, including both individuals reporting misdelivered mail ("Reporters") and businesses registered to receive notifications ("Senders").

2. Description of Service

Misdelivered provides a platform for:

• Individuals to photograph and report misdelivered mail
• OCR-based address extraction from mail photos
• Matching reported mail to registered business senders
• Notifying senders about misdelivered mail addressed to them
• Tracking environmental impact of mail recovery

3. User Responsibilities

For Reporters (Individual Submitters)

• You must only photograph mail that was misdelivered to your address, not mail addressed to you or mail you found in public spaces
• You must not open, read, or tamper with misdelivered mail — only photograph the exterior
• You acknowledge that mail photos may contain other people's names and addresses, which constitutes personal information
• You must have good faith intent — reporting mail to help it reach its intended recipient
• You must not use the Service for harassment, stalking, or any unlawful purpose

For Senders (Business Accounts)

• You must provide accurate business information and addresses
• You are responsible for maintaining the security of your account credentials
• You must not misuse misdelivery reports or recipient information
• Subscription fees (when applicable) are non-refundable except as required by law

4. Privacy & Photo Handling

Our handling of photos and personal information is governed by our Privacy Policy. Key points:

• Photos are automatically deleted 30 days after submission
• Only OCR-extracted address data is retained for matching
• Photos are never shared with third parties for marketing
• Registered senders receive only confirmation that mail addressed to them was reported — not the full photo or unnecessary recipient details

5. Points & Gamification

Misdelivered awards points and badges for submissions, referrals, and social shares. These are:

• Intended for personal recognition and environmental impact tracking only
• Not redeemable for cash, products, or services
• Subject to change or discontinuation at our discretion
• Void if obtained through fraud, automation, or abuse

6. Intellectual Property

You retain ownership of photos you submit. By submitting, you grant Misdelivered a limited, non-exclusive license to:

• Process the photo for OCR and address extraction
• Display the photo in the submitter's own profile/dashboard
• Use anonymized, aggregated data (not your photos) to improve the service

7. Prohibited Uses

You must not:

• Submit photos of mail that is not misdelivered (e.g., your own mail, spam/junk mail you dislike)
• Use the Service to gather personal information about others
• Attempt to access another user's account or data
• Use automated tools to submit reports in bulk without authorization
• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
• Use the Service for any purpose that violates applicable law

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with reasonable notice
• Experience downtime due to factors beyond our control
• Modify or discontinue features with reasonable notice

9. Limitation of Liability

Misdelivered is provided "as is" and "as available." To the fullest extent permitted by law:

• We are not liable for any loss resulting from misdelivered mail that is not successfully matched or returned
• We are not liable for errors in OCR processing or address matching
• We are not liable for damages arising from your use of or inability to use the Service
• We do not guarantee that any misdelivered mail will reach its intended recipient

10. Indemnification

You agree to indemnify and hold harmless Misdelivered and its operators from any claims arising from your use of the Service, including but not limited to claims related to your submission of mail photos containing personal information of others.

11. Termination

We may suspend or terminate your access to the Service for violation of these Terms. You may delete your account at any time by contacting us. Upon termination:

• Your points, badges, and referral history will be lost
• Any pending submissions will remain in the system for matching purposes
• Your personal data will be handled according to our Privacy Policy

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the jurisdiction where Misdelivered operates.
